Per curiam, the Supreme Court of Colorado finds former Arapahoe County District Court Judge John E. Scipione will be publicly sanctioned and required to pay attorney fees for disciplinary proceedings related to his violation of eight judicial conduct rules. Scipione used his position as a judge to seek intimate relationships with subordinate employees on at least three occasions, sexually harassed at least one employee, and failed to disclose intimate relationships with former law clerks and other personnel. While his resignation ensures he will commit no further misconduct, he will also be required to pay $51,000 in attorney fees. Affirmed.

J. Cain denies a request by a Texas-based law firm to reject a lower court’s recommendations that it be barred from intervening in a former client’s suit to recover fees and out-of-pocket expenses prior to its lawyers’ suspension from the practice in Louisiana for using modern-day runners to get clients, a state-law felony. The firm unsuccessfully argued the magistrate judge exceeded her authority and failed to apply the correct legal standards in her report. However, the ruling agrees with the magistrate judge’s conclusions the firm’s assertions fail to support its request for intervention and that the firm has acted with so little regard for the rules of ethics and professional conduct that it deprived itself of the ability to provide any meaningful service to clients with legitimate claims.

J. Cain denies a request by a Texas-based law firm seeking to intervene in a former client’s suit against an insurer, rejecting the firm’s attempt to recover attorneys’ fees and out-of-pocket expenses expended on the case after its lawyers were suspended from the practice of law in Louisiana on misconduct allegations. The litigant argues, and the court agrees, that she dismissed the disgraced law firm for cause. She never spoke with an attorney from the law firm about the retention agreement, and although she received an email telling her they were filing a lawsuit on her behalf, she never spoke to an attorney about the decision to file suit.

Per curiam, the Supreme Judicial Court of Massachusetts affirms the disbarment of James Hayes and partially denies his motion to supplement the record. Substantial evidence regarding his misconduct, including assisting clients to engage in fraudulent conduct and misusing client funds, supports the disbarment, and Hayes failed to offer most of the documents at the hearing. J. Silva grants the investment company and union's motion for $138,500 in attorney fees. The attorney acted recklessly by failing to voluntarily dismiss the union member's duty-of-fair-representation claim when it was clear that it was meritless. He also acted in bad faith by failing to inform opposing counsel/the court that he was abandoning an FMLA claim until after the issue had been fully briefed at summary-judgment, by misrepresenting evidence and case law, by raising novel arguments first in reply briefs and at oral argument, and by violating local rules. The investment company provides sufficient information on which to base an award of fees for work related to summary judgment.

J. Campbell finds the lower court properly suspended an attorney for his role in the failed representation and administration of an estate, finding that he violated three rules of professional conduct. While the instant court agrees with the lower court’s findings, it finds the punishment too light, and modifies it to impose a one-year suspension, with six months to be served as active suspension, a fixed probation period with any violation of the conditions resulting in procedure under Tennessee Supreme Court Rule 9, section 14.2. Affirmed in part.
